According to the final rule to be published in the federal register on January 8, officials said, it is aimed to protect the economic interests of US workers and better ensure the selection of deserving & most highly skilled candidates. Foreign workers benefit from the new wage-based system.

In the non-immigrant visa category H1-B, the visa allows United States companies to recruit foreign workers in specialty occupations that require theoretical or technical expertise. The technology companies depend on it to hire thousands of employees each year from other countries like India.

With the latest H-1B visa cap selection process, the motive is employers to offer higher wages and petition for higher-skilled positions, and establish a more certain path for businesses to reach personnel needs and remain globally competitive, said USA Citizenship and Immigration Services. It’ll break abuse of the H-1B visa program to fill relatively lower-paid, lower-skilled positions, which may be a significant problem under this selection system, it said.

Coming Season for H1-B Visa 2021

The final rules are going to be effective 60 days after its publication within the Federal Register. The next H-1B non-immigrant visa season is to start on April 1.

Currently, Every year the USA administration issuing 85,000 H-1B work permits among which 65,000 are allotted to people with specialty occupations and the remaining to foreign workers who graduated from the US.
